Can I appeal against a statement of account based on a tax return completed using the MyGuichet assistant?
Yes. Whether you have received a provisional statement or a final statement after using the MyGuichet wizard to complete your tax return, you can still lodge an appeal with the ACD within three months of being notified of the statement in question.
Appeal against the provisional statement
Useful as soon as you notice, after receiving it, that a piece of information has not been entered correctly in the MyGuichet assistant. For example:
- A deduction that has been overlooked (loan interest, pension contributions, travel expenses, etc.);
- Income incorrectly declared or allocated to the wrong category;
- A change in family circumstances not taken into account (change in tax bracket, marriage, birth, divorce, etc.).
Please note: lodging an appeal does not suspend your payment obligations!
The tax assessment you have received takes effect immediately, regardless of whether you lodge an appeal:
- If you owe additional tax: the amount must be paid within one month of receiving the notice to avoid late payment interest or penalties. Payment does not prevent you from lodging an appeal; these are two separate procedures. If your appeal is successful, the overpayment will be refunded to you at a later date by the ACD.
- If you are due a refund: we recommend that you take the necessary steps now to receive it, without waiting for the outcome of the appeal. If your claim results in an additional refund, the tax office will send you a second letter once your case has been processed, along with the additional payment.
